What the decision found

The Washington Post, as republished by Missouri Lawyers Media, reported that the office of Disciplinary Counsel Hamilton P. Fox found that Clark violated ethics rules by drafting a Justice Department letter to Georgia officials urging the state legislature to call a special session on the 2020 election.2

Response

According to the Washington Post report, Clark's attorneys argued that he never sent the letter and that attorney-client privilege protected him. After the Board's recommendation he wrote on X, "The fight continues," UPI reported. He called a May 2026 Justice Department lawsuit "an important step to vindicate the separation of powers."2,1

Appeal and later events

On 13 May 2026 the Justice Department sued in federal court in Washington, naming Disciplinary Counsel Fox, the Board on Professional Responsibility and the DC Court of Appeals, and asked a judge to void the findings against Clark, according to the Washington Post report. CNN reported on 14 May 2026 that Clark was still an attorney in good standing in the DC Bar, according to bar records. The Washington Examiner reported on 21 July 2026 that the DC Court of Appeals had not yet decided whether to disbar him.2,4,3
